The Municipal People's Party submitted a motion in Parliament next Thursday with the aim of filing an administrative appeal before the Court of Alicante, against the agreement of the Consortium for the Implementation of the Provisions of Waste Zonal Plan of the seventeenth area (part the Diputación de Alicante), which has rejected all allegations made by the city of Murcia against the installation of a landfill site in the Gun of Orihuela, near Zeneta.
In addition, the Consistory of Murcia will use all legal means at its disposal before the competent bodies to avoid the location of the refuse, in defense of citizens of the municipality of Murcia affected.
The City Council presented these arguments to defend the general interests of the municipality and in particular the residents of Zeneta and adjoining districts.
The Consortium for the Implementation of the Provisions of Waste Zonal Plan of the seventeenth area approved June 16, 2008 an amendment to the landfill facility near the town of Murcia (Finca La Pistola near Zeneta) away from the hamlet of Torremendo (Orihuela), which originally stood.
The City Council made allegations against the change of location and the Consortium decided on December 22, 2008 dismissed the allegations.
Again, the City Council made the request to the Governing Board of the Consortium to annul the agreement of December 22, indicating that the notification does not realize sufficiently informed of any arguments to justify the denial of the allegations.
The Consortium, December 21, 2009 again dismissed the claims of the City of Murcia.
The arguments presented by the City include:
"Formal defects in the processing of the modification of the Project and Project Management for works, without following the requirements in the Contract Law of Public Administration.
- No one can argue as public interest away from a population center (Torremendo) from three to six kilometers in early to stay with the approval of the new location, where such acts turn away the approach of those three miles to other towns (Zeneta and Urbanization The Pinada).
- Project Management and Waste Plan has been submitted for approval to the strategic environmental assessment in accordance with Law 9 / 2006, dated April 28, evaluating the effects of certain plans and programs on the environment.
"There is a change in technical approach that informed the initial assignment and modification of the project, considering an initial report to locate a recovery and disposal facility on the farm now chosen" could hardly succeed processing the Integrated Environmental Authorization to the Department of Land and Housing. "
"The choice does not meet the proximity principle established in the Area Waste Plan XVII Zonal by keeping the recovery and disposal facilities for producing villages.
"Environmental studies contributed to the decision to change the location of the facility are of little technical importance and also have not considered the aspects that may affect the municipality of Murcia.
