"The City Council, guarantee the relocation of the two elders of the Senda de Granada" (27/06/2008)

The ruling of the Superior Court of Murcia is based on the disruption of general interest and economic harm being caused to the City Council to be paralyzed the work of Miguel Indurain Avenue

Murcia City Council, guarantee the relocation of the two elders of the Path of Granada and it recognizes the Court of Justice of Murcia indicating that the rights of stakeholders (Pardo and Pedro Camacho Violante) are considered sufficiently protected with the amount paid by the city of Murcia to pay rent until they can relocate in housing being built for this purpose.

The City Council recognized Camacho Pardo and the right of resettlement as a result of the expropriation of their property for the construction of the Avenida Miguel Indurain, the road section from Alicante to the Plaza of the Cubes.

At the time of the relocation will not be paid was (and is) available homes so that they received 163,034 euros in compensation for the expropriation of their property, which amount includes 10,428 euros for the rental of a dwelling by a period of 18 months until they are built resettlement homes in holding the City in Juan Carlos I (42 units) and Casillas, and will be completed in early 2009.

According to the indictment November 2, 2007 the Court of Administrative 6 Murcia, the request for the eviction of Pardo and Camacho until their relocation to take place interim housing of similar characteristics.

The ruling was appealed by the City and according to Case 539/08, the City has no legal obligation to provide housing under the same conditions to the expropriated.

The Act establishes the obligation to guarantee the right to relocation of property owners, something that has always made the City Council, but does not require that the property is in the same situation and housing characteristics that must be evicted.

Furthermore, the decision is based on the disturbance of the general interest and the economic damage being done to the City as a result of the stoppage of the works of Miguel Indurain Avenue.

One avenue that connects South Round Juan Carlos I closed the city to the east with three lanes in each direction and 7 miles long, and that is expected should be completely opened to traffic in September this year.

This is an avenue under the General Plan, adopted in January 2001.

The ruling also indicates that corresponds to the Council seeking rental housing, but to the families of Brown and Camacho.
