IU-Greens Murcia today sent an internal communication to the mayor of the municipality, Miguel Angel House, by expressing its negative, based on legal provisions, removing the flag of the Second Republic waving on the balcony of the municipal group from few days ago.
This communication is the response to a letter sent by House to municipal group spokeswoman, Esther Herguedas, to proceed with the removal of the flag for "not correspond to that determined in the Spanish Constitution or the law governing national flag ".
IU-Green replied that neither the mayor nor the Basic Law that legislation, as well as any other standard use of municipal facilities, prohibit the display of that emblem.
"The display of this flag does not affect the legal provisions meritadas before, does not remove centrality or prominence to the flag of the Spanish Constitution of 1978, as, indeed, it does has been done for years on the City Council with placing a giant party banner in the center of the town hall, "said the letter.
It points out that several judgments that determine the legality of the public display of republican flags as Case 1335/2003, the Supreme Court of Madrid, in which fault is declared contrary to law, it violates the fundamental rights under Articles 16.1 and 20.1, a), a resolution Torrelodones Mayor (Madrid) ordering the removal of a republican flag of a municipal house party.
The feeling of many people
Herguedas assured that exposure Flag "reflects the feelings of many people who do not want to be seen as subjects but citizens" and has demanded a referendum to choose between society monarchy or republic.
"We're not breaking any laws, we use our freedom of speech and thought only, and will continue to do so until we have a firm resolve other" added Herguedas.
