"The fight against Holocaust denial law: a dangerous border" is the title of the thesis in international joint supervision between the University of Murcia and the University of Bologna, which has been advocated by researcher Murcia educational institution Germán Manuel Teruel Lozano at the Royal College of Spain in the Italian city.
Germán Teruel, who obtained excellent cum laude from this work in the same holding that freedom of expression "should cover any kind of speech, however hateful it is, such as Holocaust denial or other serious crimes ".
This, says the author, "except for the content, intent and context of the speech can be proven in court that they are manifestations or are insulting or degrading or generate a real and imminent danger to the commission of crimes."
The study, which was led by professors from the University of Murcia Jaime Peris (professor of criminal law) and Angel Garrorena (Emeritus Professor of Constitutional Law) and the University of Bologna Andrea Morrone, criticism can be excluded from protection a type of speech constitutional by its pure "ideological content".
Of this issue is very topical, since there is a European standard that seeks punishment of such speeches and Spanish and Italian parliaments also discuss the inclusion of an offense of this kind.
The court valued the thesis was composed by Italian criminal Ferrando Mantovani, the Spanish Constitutional Court exmagistrados of Aragón and Jorge Manuel Rodríguez-Zapata and Professor at the University of Pisa Roberto Romboli.
