This high commissioner of the Cortes has issued a resolution suggesting the Consistory to initiate the procedure for the appointment of members of local environmental associations to form part of the Social Council
If the City Council does not respond to the application for membership, Huermur will go to the courts and to Europe to review the proceedings of this Consistory in reference to citizen participation in environmental matters
The Association for the Conservation of the Garden and the Heritage of Murcia (Huermur) requested last January 2016 the mayor of Murcia to enter the Social Council of the City, as a local environmental association in accordance with the provisions of its operating regulations.
During months, Huermur was reiterating by means of writings by registry and electronic mails to the mayorship and Secretary of the Plenary, information about the application of entrance in the Council, without obtaining any answer.
So he raised this situation to the Ombudsman in the Cortes, requesting his intervention to clarify what was happening.
After months of research and documentation requirements to the City of Murcia, this high commissioner of the Cortes Generales has issued a resolution asking the Consistory to "initiate the procedure for the appointment of members representing local environmental and environmental associations , in accordance with articles 4 and 5 of the regulatory organic regulation of the Social Council of Murcia.
Huermur points out that this resolution of the Ombudsman has been reached after an intense analysis of the current situation of the Social Council, and where this high commissioner has come to point out that according to the regulations it is foreseen that "the associations established with the aim of protecting the environment is part of the Social Council, and it is not optional that, by decision of the Mayor, their participation be excluded and the representation of said interests in the Council prevented, as provided in the Regulations ".
From Huermur point out that the Ombudsman has dismantled all the excuses put by the Mayor to stop environmental associations at the local level can be part of the Council, as this participation is covered by the Aarhus Convention, various regulations and even mandates enshrined in the Constitution.
In the same way, the Ombudsman states in his resolution that the Social Council is a suitable body to favor the participation of the public in matters affecting the environment and in which the defense of the latter must be represented and attributed to the associations that are specifically constituted for that purpose.
The issued resolution concludes that recognizing the participation of environmental associations in the Council and designating the members that represent them, is not only mandatory under the Regulatory Regulation, but also favors the participation of citizens in matters that significantly affect the environment. local environment, a right that Administrations must provide.
In this sense is pronounced Huermur, who has asked the Mayor to meet this request of the Ombudsman, and start the procedures requested, it is necessary that the Social Council of our city has a proper representation of the most representative environmental associations in the local scope
Also from the association ask the Consistory to attend the request for admission to the Council made by Huermur, and stop saving it by the drawers of the Glorieta.
In the same way, from Huermur indicate that if the application submitted by the association is not resolved, they will go to court and do not rule out going to Europe to review from the Aarhus Convention the actions of this council in reference to citizen participation in matters of environment, heritage, and territorial planning.
