The City Council will arbitrate an information system to determine which capital gains are affected by the judgment of the Constitutional Court (25/05/2017)

The City of Murcia will provide the necessary material and human resources so that taxpayers who have not obtained capital gains from the transfer of real estate located in Murcia can claim the amounts paid as a Tax on Increasing Value of Urban Land.

This was one of the agreements approved today at the Plenary meeting with the support of the whole Corporation, on the proposal of a motion presented by PP, PSOE and Citizens.

In the session, it has also been decided that the City of Murcia will join the demand of the Federation of Municipalities and Provinces, demanding to the Government of Spain the compensation to avoid the loss of resources that will suffer the municipalities due to the Judgment of the Constitutional Court Of May 11, 2017, that declared the unconstitutionality and nullity of several articles of the Law of Local Haciendas

Therefore, the City Council urges the Government of Spain to urgently modify these regulations to establish the necessary legal framework to regulate the tax increase in the value of urban land.

For this reason, the Department of Finance will initiate the necessary procedures for the revision of the Ordinance, in line with the ruling and with the modifications or adaptations made by the Government to arbitrate the way of not submitting to taxation situations of no increase Of value of urban land.
