The Ministry of Culture opens a robbery file for the demolitions of the Old Prison (23/07/2020)

Huermur denounced the facts and the intentions of the Murcia City Council about the demolitions of the Old Provincial Prison to the Ministry of Culture, and now it has opened the corresponding file to investigate the alleged plundering statement, making use of its state powers.In this way, the ministry applies article 4 of Law 16/1985 on Spanish Historical Heritage, having admitted the claim for processing after verifying the circumstances reported, and has requested explanations about what happened to the Murcia City Council and the Autonomous Community.

with the historic prison building, as well as the issuance of a report, to adopt the appropriate measures from Madrid.Huermur has had to denounce in the Ministry everything that happened about the Old Prison, before the passivity of the Ministry of Culture, and the excesses of the Murcia City Council that is determined to destroy the walls and most significant elements of the prison building.The Association for the Conservation of the Huerta and the Heritage of Murcia (Huermur) has managed to get the Ministry of Culture to open a file and the corresponding investigation for alleged plunder, after the group denounced the facts that are happening about the demolitions of the Former Provincial Prison of Murcia, also known as the Old Jail and which was opened in 1929.Huermur sent a complaint to the Ministry, in application of Article 4 of Law 16/1985 on Spanish Historical Heritage, which indicates that for the purposes of this Law, plunder is understood as any action or omission that endangers loss or destruction.

Now, the General Directorate of Fine Arts of the ministry, after verifying the circumstances of the complaint filed and in the exercise of the powers granted by the aforementioned Law and article 57 bis of Royal Decree 111/1986, has opened a file to investigate the facts reported and take the necessary measures.The collective points out to the ministry that the building of the Old Prison today holds provisional protection as a BIC Cultural Interest Property, which was granted in 1998 after the opening of the corresponding file on that date, and which also has two favorable reports from advisory entities, one from the Royal Academy of Fine Arts of San Fernando, and another from ICOMOS.

Both reports have already been forwarded to the ministry.

The foregoing means that such procedure for the declaration as BIC of the former Provincial Prison has never been declared expired, and therefore has not been completed today, so the building has, provisionally, the category of BIC as stipulated by the legislation on cultural heritage.Huermur points out that there are countless obstructions that are being received by both the Murcia City Council and the Ministry of Culture, so that the demolitions that are being carried out on the Old Jail do not stop, so it has had to go directly the Ministry of Culture to ask for protection and solutions.

The conservation entity does not rule out equally and if necessary, take the matter to European instances.In this sense, the President of Huermur, Sergio Pacheco, has stated, indicating that: "We have already said that we would go to the necessary instances, and we would use any legal means within our reach to avoid the disappearance of fundamental elements of the old prison.

Murcia does not deserve to lose a single element of its heritage and its history under the stake of the city council.

"Finally, Huermur hopes that the Ministry of Culture will get to the bottom of the matter and agree to urgently stop the demolitions to avoid irreversible damage, as well as supervise the procedure for the protection and safeguarding of this heritage for all Murcians.
