Tradition and huertana honor to settle disputes irrigation in the Council of Wise Men (26/02/2016)

The Mayor of Murcia, José Ballesta, President of the Chamber of the High Court of Justice of Murcia, Rubén Jiménez Fernández, attended today's session the Council of Good Men held in the Hall of City Hall, and in which three trials irrigation conflicts in the Huerta de Murcia were settled.

The Plenary Hall hosted this session coinciding with the celebration of the First Week of the Huerta de Murcia, an event which will run until next Sunday and which aims at raising awareness, protection and enhancement of ecological, landscape and cultural heritage Huerta de Murcia.

To this end, it has enjoyed the active participation of various groups, associations and groups, including the Council of Wise Men, which last met in the City a year and a half ago.

The Council meets the demands of the residents of the environment of the Huerta de Murcia who consider themselves wronged by conflicts related to the channels of irrigation (over irrigation ditches, minor irrigation ditches, armbands and showers) and channels drain (over ditches, landronas azarbes, azarbetas and escorredores).

The court consists of four members (two of Alquibla and two Aljufía -the two largest irrigation ditches leading to the Huerta de Murcia-, a secretary, the marshal and a president.

The Council acts ordinarily every Thursday of the year, conducting conciliation sessions in which satisfactory agreement for both parties are achieved in 95% of cases, so the three cases that have led today to trial represent a small minority of all unresolved conflicts.

The three cases ADJUDICATED

Specifically, one of the trials that took place today affected a neighbor of the Way of Santa Catalina, who complained of undue enclosure that left inside a watering can (minor channel), which supplied water to other adjacent parcels environment.

The other cause also -open for regante the Way of Santa Catalina was motivated by the installation of a door that blocked one step away from irrigator.

The third lawsuit denounced the occupation of 'quijero' of the ditch (the lateral path of the channel), at the request of an irrigator Zaraiche the ditch, near El Esparragal.

Litigation, step by step

The three trials were oral, as usual marks, and have been chaired by Vice President of the Board of Landowners, Patricio Ballester.

At each session, the same order is followed: first reading is given to the application filed in the presence of the two sides: plaintiff and defendant, and realizes the actions and inspections carried out by the Council in order to ascertain the facts.

The plaintiff took the floor and, after ratification in fact, argues demand.

Then turn assumes the other party has the opportunity to defend its position in court.

This will assess the documentary or forensic evidence that both parties want to present.

If the members deem it appropriate, a question-opens.

Once exposed the conflict and with the testimonies and evidence collected, comes the deliberation of the court, which is secret.

The ruling issued is firm, since Council decisions are law.
