Change Murcia raises to the Plenary a proposal to repeal the crime of insults to the Crown (28/11/2018)

The motion is part of a campaign that reaches all levels of public administrations, from the Congress, the CCAA and municipalities

Murcia change is going to ask the plenary tomorrow the City Council to urge the central government to repeal the crime of insults to the Crown and allow the investigation in parliament of the actions of King Emeritus, Juan Carlos de Borbón, since 2014, when he left to be inviolable from the legal point of view, to date.

The motion, which will be defended by councilman Sergio Ramos, also calls for equal criminal protection of the monarch's honor and the Royal House with any person, as well as the convocation of a referendum so that citizens can decide if they want to continue with the monarchy as a form of the State, or establish a republic.

Ramos recalled that the European Court of Human Rights (ECtHR) issued a ruling in March condemning Spain to return a fine paid by two young people for burning 11 years ago a photo of the King, considering it was "an expression symbolic of political criticism ".

In this judgment, European justice refers to the violation of Article 10 of the European Convention on Human Rights, regarding the right to freedom of expression, by the Spanish courts, the National Court and the Constitutional Court. of Strasbourg also has "very clear and solid jurisprudence" by virtue of which the ordinances can not grant special and qualified protection to their most important positions and institutions, but, on the contrary, must allow a greater degree of criticism .

This contrasts, in the words of the mayor, with the great protection offered by the Penal Code to the members of the Royal Household, in relation to that of any other institution or citizen of the state, especially through the crime of insults to the Crown, collected in articles 490.3 and 491.

The ECHR's position is in line with what the Council of Europe and the UN Human Rights Committee have defended, for whom freedom of expression "is the cornerstone of all free and democratic societies," and even that exercised "without inhibitions in the public debate about public and political figures".

Ramos has also made reference to the budgetary agreement between the parliamentary group of Unidos Podemos in Congress and in the Government, which includes the modification of the aforementioned articles and those that regulate offenses of offense to religious sentiments.

He also mentioned the approval by the lower house of a law for the protection of freedom of expression promoted by Izquierda Unida within the Unidos Podemos group, which includes precisely the agreement on the reform of articles of the Criminal Code.

Investigation to the king emeritus

Ramos has insisted that the recordings of the German businesswoman Corinna Zy Sayn-Wittgenstein show that "there is more than enough evidence" to initiate an investigation of Juan Carlos I, despite the rejection of the Congress, on two occasions, to carry out such acting.
