Navarro: 'It is tendentious to point out that the AYS School was operating without a license when it was awarded the Work and Activity since 2003' The Councilor for Urban Planning, Environment, Water and Garden qualifies as' petty the use (30/10/2018)

The school occupies a floor classified by the General Plan as corners and headwaters of the Segura, not being specially protected, and where educational and sports equipment is expressly admitted as exceptional uses.

'It is discouraging and petty that, in exercise of the right of access to municipal information of a Political Group, the Justice Administration is used for political purposes, calling into question the professionalism and impartiality of the technicians involved in the urban planning' said Antonio Navarro, after learning that now Murcia has taken the license of the AYS school to the Prosecutor's Office, showing once again the 'torturous use they make of the courts, where they expect to find what the citizens deny them'.

Regarding the license of the school, on April 17, 2002, the Ministry of Public Works grants the exceptional authorization for public interest of this teaching equipment in a non-developable land classified by the General Plan as corners and headwaters of the Segura, not being specially protected (article 7.2.14 of the regulations of the General Plan that indicates it as inadequate for urban development) and where educational and sports equipment is expressly admitted as exceptional uses, as is the case, with the conditions of buildability that establishes the General Plan.

In this sense, it is indicated in the authorization of public interest that the planned building surface must conform to the maximum buildability allowed by the General Plan.

In the documentation provided, the area of ​​land linked to the action is 12,953 m2, so that the parameters of surface and buildable (2,000 m2 of minimum plot and 0'3 m2 / m2) are met.

Likewise, the favorable report of the General Directorate of Culture is included, there being no allegations in the period of public information.

After this exceptional authorization, and after processing the corresponding file, and issuing the mandatory technical reports in which the adjustment of the project is verified to the content of said authorization (plot area, buildable), it is granted on February 7, 2003 joint license of works and activity.

On April 29, 2015, as a result of a change of ownership of the license, the start-up is requested.

After the evacuation of all the favorable reports (Industrial Engineering, Health, Environment, Fire Protection and the Technical Report) is granted on April 12, 2016.

Checked the files of the Department, there are no complaints or infringement parties motivated by this license.

"It is tendentious to point out that the School was operating without a license when it was awarded the Work and Activity since 2003," says Navarro, who recalls that "the Commissioning in the current regulations only requires Communication of Start of Activity."

Finally, the Special Plan for the Protection of the Malecon, which aims to protect the BIC and is pending approval by the Plenary Session of the City Council.
