Now Murcia demands the control of exceptional authorizations on undeveloped land in the municipality (23/10/2018)

NOW MURCIA demands the control of the exceptional authorizations to build in undeveloped land of the municipality of Murcia, since it understands "that this procedure is being abused, building a large number of industrial buildings and other installations on undeveloped land protected by means of of exceptional authorizations, which causes damages in environmental values ​​and in the soil ".

The councilor Angeles Micol points out that it is essential that the authorization of public interest for installations on undeveloped land "comply with strict compliance with current legislation, in each case requiring the proper justification of the public utility or social interest nature of the actions in question and the need to locate in the intended location, as this procedure is highly restrictive and exceptional ".

The municipal formation will defend a motion on this matter in the plenary on Thursday.

Micol affirms that "for several months the repeated publication in the BORM has been detected of numerous announcements about exceptional authorizations of public interest in undeveloped land of our municipality, in spite of the fact that the current Land Law of the Region foresees this process of authorization as exceptional, which should be applied only in very specific situations ".

The mayor stressed that "the concept of public interest is an indeterminate legal concept, which must be interpreted in any case restrictively, because otherwise it would be turning an exceptional procedure into something normal and ordinary, being able to incur in fraud of law. fundamental to protect the environmental, landscape and cultural values ​​of the non-developable land, which, if it has that cataloging, is for something and that, we insist, we should only be able to build on it exceptionally ".

"A part of the exceptional authorizations are for the installation of industrial activities on undeveloped land," he adds, "and in this sense, the City of Murcia must be aware that in the municipality we have the West Industrial Estate, as well as numerous land properly classified for the installation of industrial activities, these places being prepared for the development of the aforementioned industrial activities and where they would be developed without problems and without the need to use the exceptional procedure of Law 13/2015, of March 30, Territorial and Urban Planning of the Region of Murcia ".

In the same line, Micol points out that "this type of activities for which exceptional authorizations are being requested must be located in polygons and ordered industrial zones, because in this way and in this location suitable for their development, tissue growth is favored business located in the strategic areas for this purpose, which are the industrial estates and zones stipulated in the PGOU of Murcia and regulated by the guidelines of industrial land.
