Cs requests the annulment of the agreement of the Governing Board that allows the delegation of powers in the minor contracts (17/05/2018)

Orange training has challenged this agreement to consider that the Governing Board can not delegate hiring powers to councilors, creating a structure aimed at skip the limitations imposed by the new law of public sector contracts

The municipal group Citizens has requested the annulment of the agreement of the Board of Governors on April 20 because it considers that it violates the new Public Sector Contracts Law by delegating the powers to the councilors and treating the districts as if they had legal capacity to contract.

"In this way," explained Gomez, "each district could have a maximum of 40,000 euros for works contracts and 15,000 for supply contracts or services to a single provider, when we understand that the law of public procurement fixed this limitation for the municipality as a whole ".

"Reasons for which we consider void the agreement of the Governing Board", said the spokesman of Cs, who, in this regard, stressed that "depending on the resolution and justification by the competent body we will study the adoption of other possible measures "..

The exception, not the general rule

Gómez wanted to influence the spirit of the new public procurement law that aims to reduce minor contracts to the minimum, making them exceptional, not the general contracting rule of local government that requires public bidding, against what -in the opinion of the orange training- "the PP intends with the agreement adopted in the Governing Board which is none other than to follow a system of expired contracting that promotes corruption and that tries to avoid the control filters".

Contracts to finger

"We can not allow them to take place, we are talking about 2017, about 35,000 contracts per year (about 100 a day), and without following the principles of publicity, transparency, equality and competitive competition;

nor that the same company invoices to the City council more than 1 M € formalizing 700 annual contracts (two to the day including the weekends and holidays) of less than 9,000 € ", has underlined the councilman of Cs Carlos Peñafiel.

"A common practice that must be banished by eliminating patronage networks and farmhouses sustained for decades by the PP Government", denounced Gómez.

Thus, the councilors have insisted on the need to "put an end to this system to move towards an agile and transparent City Council that seeks contracts for better quality-price, as well as implement social and environmental policies pursuing the efficiency of spending public, respecting equal treatment between companies and non-discrimination. "

"If the PP is not willing to do it, in Citizens we will do it when we have the opportunity, we will comply with the law and we will reduce the smaller contracts to the maximum, leaving them for the exceptional cases that the law", they have concluded.
